Terms of Service

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

You may need an account to use certain features. Authentication is currently provided via Google through Firebase Authentication. You are responsible for:

• Maintaining the security of your identity-provider account
• All activity that occurs under your Noppera account
• Providing accurate information associated with your account

Notify us promptly at hello@elphame.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

Noppera is a practice sandbox for social skills, persuasion, negotiation, and difficult conversations using AI-generated characters, scoring, coaching insights, debriefs, and optional public sharing in Explore. Features may change, be limited, or be discontinued at any time.

AI outputs are probabilistic and may be inaccurate, inappropriate, biased, or inconsistent. The Service is for practice and educational purposes only. It is not professional advice (legal, medical, mental-health, financial, HR, or otherwise) and is not a substitute for real-world judgment or qualified professionals.

You agree not to:

• Use the Service for any unlawful purpose
• Create, upload, or request content that is illegal, exploitative, or involves sexual content involving minors (we have zero tolerance for child sexual exploitation material)
• Harass, threaten, defame, or impersonate others in a way that facilitates real-world harm
• Attempt to bypass content moderation, safety filters, or rate limits
• Scrape, reverse engineer, or interfere with the Service, its APIs, or infrastructure except as allowed by law
• Use the Service to develop competing models by systematically extracting outputs at scale, or to spam / abuse third-party AI providers through our Service
• Upload malware or attempt unauthorized access to accounts, systems, or data
• Publish characters or content that infringes intellectual property or privacy rights of others

We use automated moderation (including third-party moderation APIs and safety checks) and may remove content or restrict accounts that appear to violate these rules.

You retain ownership of content you create (character setups, messages, goals, and similar “User Content”), subject to the licenses below. You represent that you have the rights needed to submit User Content and that it does not violate law or these Terms.

You grant Noppera a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify (for formatting/technical purposes), display, and transmit User Content as needed to operate and improve the Service — including sending relevant content to AI and infrastructure providers, generating portraits, and showing public characters in Explore when you choose to publish them.

If you make a character public, other users may view its public fields. You can change visibility or delete content subject to technical limitations and residual copies in backups or processor systems for a limited time.

The Service — including software, branding, UI, logos, and original materials we provide — is owned by Elphame, LLC or its licensors. Except for the limited right to use the Service under these Terms, no rights are granted. You may not copy, modify, or distribute our branding or software without prior written permission.

AI-generated portraits and text outputs are provided for use within the Service and for your personal practice. Additional commercial exploitation of generated assets may be restricted by third-party model/provider terms.

The Service relies on third parties such as Google/Firebase, Cloudflare, Anthropic, OpenAI, Fal.ai, and DiceBear. Your use of those services through Noppera is also subject to their applicable terms and privacy policies. We are not responsible for third-party outages, policy changes, or acts outside our reasonable control.

The Service is currently free to begin. We may introduce paid plans or limits later. If we do, we will provide notice and any additional payment terms before charging you. We do not process payment card data ourselves today.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE OR APPROPRIATE FOR YOUR SITUATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELPHAME, LLC AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50 IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Noppera and its operators from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time and may delete your account from Profile, subject to the data practices described in the Privacy Policy. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will survive termination.

We may modify the Service and these Terms. We will post updated Terms with a new effective date. Continued use after changes become effective constitutes acceptance, except where the law requires additional consent. If you do not agree, stop using the Service and delete your account.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply and cannot be waived.

Subject to those mandatory rights, you and Elphame, LLC agree that exclusive jurisdiction and venue for disputes arising out of or relating to these Terms or the Service shall lie in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices may be provided via the Service or email.
